This agreement will settle all of the Navajo Nation, Hopi Tribe, and San Juan Southern Paiute Tribe water rights claims in Arizona, as follows: Upper Basin of the Colorado River, Lower Basin of the Colorado River, Little Colorado River (LCR) Basin, Groundwater (including the Navajo Aquifer (N-Aquifer), the Coconino Aquifer (C-Aquifer), and alluvial aquifers), Gila River Basin (Big Boquillas Ranch)

Winters Water Rights Revived After Navajo Nation Case

For more than a century, since Winters v. United States, 207 U.S. 564 (1908), the Supreme Court has recognized that when the United States establishes a Native reservation, it impliedly reserves sufficient water rights to support that reservation. But many of these Winters rights, like those held by the Navajo Nation, remain unadjudicated and unquantified, creating uncertainty for junior right holders. A recent decision from the Ninth Circuit Court of Appeals confirms that the United States cannot ignore Winters rights held by tribes just because they have not been adjudicated..

Northeastern Arizona Indian Water Rights Settlement Agreement

WHO SHOULD ATTEND: All community members and leaders, elders, youth organizers, relatives living in the Upper Basin and Lower Basin of the Colorado River and the Little Colorado River.

DISCUSSION TOPICS: Indian Water Rights Law; the Little Colorado River Adjudication; and the Navajo Nation's involvement in a proposed comprehensive water rights settlement with the United States, the State of Arizona, the Hopi Tribe and the other parties.

Lunch will be provided by Navajo Nation Water Rights Commision
